Offering Plans and Declarations of Condominium
The firm represents developers of market-rate as well as affordable condominiums and cooperatives, including new construction projects, gut rehabilitations, and conversions. Our attorneys prepare Offering Plans and amendments for buildings ranging in size from less than ten units to over four hundred units in Manhattan, the outer boroughs, and in Westchester. At Seiden & Schein, P.C., we pride ourselves on seeing the "big picture," which involves careful coordination with our client's architects, managing agents, and lender's counsel to insure that our clients' needs are met. In an increasingly complex legal landscape, we deftly guide our clients through myriad of requirements established by City, State and Federal agencies. Among our projects, we have drafted offering plans for The View at East Coast, the only leasehold condominium in the burgeoning community of Queens West; 99 John Deco Lofts, a downtown Manhattan tenanted conversion project; Oro, a new construction project in Downtown Brooklyn; and the Aurora, and the Orion, two new construction projects in the Bronx which include both market-rate and affordable units.A condominium legal structure is also desirable for owners of mixed-use buildings in which units are not offered to the public. By creating a condominium regime, property owners may be able to take advantage of two or more of the City’s real estate tax benefit programs simultaneously. This strategy is particularly beneficial where the building has non-residential space in excess of 12% of its aggregate floor area. The firm has a proven track record of success in receiving "No Action" letters from the New York State Attorney General's office, and in coordinating with project architects and their expediters to see condominium projects through from the planning stages to recordation of the Declaration of Condominium.
